Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Written by Inkly ("Inkly", "we", "us"). They govern your access to and use of the Inkly website, ordering tools, API, and the handwritten-mail service (together, the "Service"). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you are authorized to bind that company.

1. The service

Inkly produces real pen-on-paper handwritten cards from the message and recipient details you provide, and mails them on your behalf via the United States Postal Service. Card stock, handwriting styles, pricing, and delivery timing are described on our site and may change over time.

2. Your account

You must provide an accurate email address and keep your login and any API keys secure. You are responsible for all activity under your account and keys. Notify us promptly at hello@byinkly.com if you suspect unauthorized use.

3. Your content and your recipients

You retain ownership of the messages, logos, and recipient lists you submit ("Your Content"). You grant us a limited license to use Your Content solely to produce and mail your cards and to operate the Service. You represent and warrant that:

You are solely responsible for the accuracy of recipient names and mailing addresses. We print and mail what you submit; we do not verify that an address is correct or deliverable unless a validation feature explicitly says so.

4. Acceptable use

You agree not to use the Service to send mail that is unlawful, that violates a recipient's rights, or that you are not permitted to send. You may not attempt to disrupt or reverse-engineer the Service, abuse the API, or resell access without our written consent.

5. Orders, pricing, and payment

Prices are shown at checkout and on our pricing page, in U.S. dollars, and are based on the number of cards and any applicable volume tier. Payment is processed by our payment provider (Stripe); by paying, you also agree to their terms. Prepaid credits, where offered, are applied to eligible orders. We may correct pricing errors and decline or cancel any order, including orders that appear fraudulent or that violate these Terms.

6. Cancellation and refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In short: an order can be cancelled for a full refund any time before a card has been written; once writing or mailing has begun it can no longer be cancelled.

7. Intellectual property

The Service, including the site, software, handwriting styles, and card designs, is owned by Inkly and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service as permitted by these Terms. You may not copy, modify, or create derivative works of the Service except as allowed by law.

8. Third-party services

The Service relies on third parties such as payment processing, hosting, scheduling, and automation integrations. We are not responsible for those third parties' services, and your use of an integration may be subject to its own terms.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that mail will arrive by a particular date; mail timing depends on the USPS and other factors outside our control.

10. Limitation of liability

To the fullest extent permitted by law, Inkly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the order giving rise to the claim in the three months before the claim.

11. Indemnification

You agree to indemnify and hold Inkly harmless from claims arising out of Your Content, your recipient lists, or your breach of these Terms, including claims that a mailing you sent was unlawful or unauthorized.

12. Changes and termination

We may update these Terms from time to time; material changes take effect when posted with a new effective date, and continued use means you accept them. We may suspend or terminate access for violations of these Terms.
